There is no reason to wait to retain an attorney until charges have been filed. If you are being investigated by the police, have been questioned and/or interrogated, or suspect charges may soon be filed against you — regardless of the facts surrounding your situation, it is imperative that you at least talk to an attorney regarding your rights. I have been practicing law since 2004, and I cannot tell you on how many occasions I have seen good people cooperate with the police, only to end up being charged. Yet had they talked to an attorney, things may have turned out differently.
It has been said time and time again in T.V. shows and on attorney websites such as this one, “[o]nly you can enforce your right to remain silent.” While this is true, people tend to get caught up in technicalities that may or may not cause a statement to be later thrown out in court. For instance, I have seen many cases where a defendant went ahead and talked to a police officer, under the assumption that their statement would be thrown out because the officer did not read them their Miranda rights (specifically the right to remain silent). Yet months later, when their case goes to court, the learn that the statement will not be excluded by the judge. As an attorney, I cannot stress enough the right to remain silent and how important it is for people to understand. If used, the right to remain silent is so powerful, that mere mention at trial of an accused person having remained silent when asked questions can cause a mistrial.
Fees and costs?
Fees are determined on a case by case basis, after the initial consultation by the attorney. Payment plans are typically available, and may require a co-signer. If a case has been filed and a potential client has already been arraigned by a judge, a down payment may be required. We accept all major credit cards, checks, money orders, and cash.
